The Court of Appeal held that where a payment made as a condition of a stay of execution exceeds the amount ultimately awarded on appeal, the Court of Appeal has power to order repayment of the overpayment as incidental to its appellate orders under s46(2)(b) of the Supreme Court Act 1970, without requiring the successful appellant to commence separate proceedings for money had and received. The Court further held that interest on the overpayment could be ordered under s95 of the Act and backdated to the date of the original overpayment, exercising the Court's power to 'otherwise order' under that section. The entitlement to interest at common law was left unresolved, the matter being determined on statutory grounds.
