The Supreme Court has concurrent power with the District Court to extend time for filing a notice of appeal from the District Court under O.90 r.6 of the Rules of the Supreme Court; the dicta in Traj v Cannery Board and the decision in Jadeborough Pty Ltd v Hudson to the contrary are wrong. O.32 r.1(3) of the Rules of the Supreme Court, permitting correction of the name of a party after expiry of the limitation period, applies in the District Court by virtue of r.4 of the District Courts Rules 1968.
