The loss of the opportunity to cross-examine additional Crown witnesses at committal does not of itself justify a stay of proceedings. Where the Crown provides statements and offers to call witnesses first at trial for cross-examination on the voir dire, the defence must demonstrate by evidence (not speculation) that substantial difficulty in trial preparation will result. The appellate court will ordinarily leave management of any residual unfairness to the trial judge rather than intervene pre-trial.
