In Queensland, applications for removal of caveats are governed by the interlocutory injunction test (serious question to be tried and balance of convenience). Where a substantial mortgage debt exceeds the value of the mortgaged property and the caveator offers no alternative security, the balance of convenience will ordinarily favour removal of the caveat. The mere existence of unliquidated damages claims relating to matters other than the mortgage transactions themselves will not ordinarily affect that position.
