The parity principle from Lowe v The Queen requires appellate intervention where a co-offender with a substantially worse criminal record, who was on probation at the time of offending, who was personally responsible for acts of violence, and who was convicted of additional unrelated offences, receives effectively the same sentence as a less culpable co-offender. The question whether the parity principle requires reduction below an otherwise appropriate sentence (per Mason J in Lowe) was left open.
