The Queensland Court of Appeal has inherent power to stay its own orders to allow a party to seek special leave to appeal to the High Court. The earlier Queensland Full Court decision in Sinnamon v New Zealand Insurance Co (No 2), which held the court was functus officio after delivering judgment, does not preclude such a stay. A stay will be granted where the question is arguable and without the stay the proposed appeal would be rendered pointless.
