The Supreme Court of South Australia has an inherent discretion to permit a non-legally qualified person to represent a party in proceedings, which is not excluded by the Legal Practitioners Act 1981 (SA). The discretion may be exercised where the interests of justice make it necessary or convenient, particularly where legal representation has ceased mid-trial due to lack of funds and the proposed representative is a family member and co-defendant with a common interest. An application by an unqualified stranger to the action would not normally be entertained.
