Suspension of a sentence of imprisonment is inappropriate where the offence of possession of cannabis for sale was committed as an incident in the course of commercial drug trading. Personal circumstances and time spent in custody do not constitute adequate grounds for suspension in such cases. On Crown appeals, the public interest in maintaining adequate sentencing standards for commercial drug offending may override the usual restraint exercised on prosecution appeals.
