In a case of fraud against a Commonwealth authority, previous good character and antecedent good conduct are particularly weighty factors that may support the invocation of s 19B of the Crimes Act 1914 (Cth). The likely consequences of conviction on an offender's employment, while not a factor supporting invocation of s 19B, are relevant to whether it is expedient to apply the section. Where the fraud involved unauthorised use of employer facilities for purposes connected with employment or a compensable condition, culpability may be at the lowest level, supporting discharge without conviction.
