Section 117 of the Patents Act 1990 does not apply to method or arrangement claims where there is no 'product resulting from such use' of the method; the section is confined to cases where the customer's use of a supplied product would itself infringe. For authorisation of infringement under s 13(1), the supply of a component capable of substantial non-infringing use, together with promotional material showing infringing use, is insufficient to establish authorisation where there is no evidence of any particular act of primary infringement. The phrase 'the same as' in s 64(2) requires strict identity and is narrower than 'identical or substantially identical' in s 64(1), and non-compliance with s 64 is not a ground of revocation under s 138.
