Evidence of uncharged transactions showing a consistent and systematic course of conduct in dealing with moneys contrary to representations is admissible to prove dishonest intent in fraud prosecutions, and goes beyond mere propensity evidence. A misdirection as to the relevance of evidence will not cause a substantial miscarriage of justice where there is no evidentiary foundation for the matters the accused sought to rely upon.
