Where the prosecution tenders a record of an accused's police interview containing both admissions and exculpatory statements, a direction that the jury may only use the statement adversely to the accused is a clear misdirection that will result in the conviction being quashed. The exculpatory parts of a mixed statement tendered by the prosecution are evidence for all purposes, not merely for qualifying or explaining admissions. A good character direction that minimises the significance of good character by telling the jury it 'does not go very far' and can only assist if they are 'teetering on the edge' is inadequate, though may not alone constitute a miscarriage of justice.
