For the purposes of the Vexatious Litigants Act 1981 (Qld), 'legal proceedings' are limited to proceedings in Queensland courts, but proceedings in other jurisdictions may be considered as evidence bearing on whether Queensland proceedings are vexatious and in the exercise of the court's discretion to make a declaration. The factors relevant to determining whether proceedings are vexatious include the legitimacy of the litigant's motives, the existence of reasonable grounds, repetition of similar allegations previously rejected, compliance with court practices and rulings, persistent attempts to circumvent court decisions, wastage of public resources, and harassment of those subject to baseless litigation.
