Where an offender's mental illness is well-documented and played a very significant part in the commission of the offence, a reduction of only one third in the period of imprisonment may be insufficient to reflect the offender's diminished culpability. In such cases, particularly where the offender is responding well to treatment and imprisonment would disrupt that treatment, a non-custodial sentence may be appropriate even for serious offences such as armed robbery.
