Calderbank letters that could not have been made as offers of compromise under the Supreme Court Rules do not attract the continuing costs consequences on appeal recognised in Ettingshausen v Australian Consolidated Press. Where an appellant succeeds on appeal but still fails to better a pre-trial Calderbank offer, the court may make no order as to costs of the appeal, particularly where the appellant also failed on a significant issue argued on appeal.
