When assessing future economic loss for a plaintiff with partial incapacity, a trial judge must not treat the risk of future total incapacity as if it has already been realised at the date of trial. Where the actual replacement labour cost at trial is significantly less than the figure adopted for the assessment, the award may be excessive. A global figure approach may be appropriate where mathematical precision is not possible.
