Section 57(c) of the Drugs Misuse Act 1986 (Qld) cannot be used to deem an occupier to be in possession of a dangerous drug where another person is in actual possession of the drug on the premises. The prosecution must rely on the general law in such cases, requiring proof that the accused knew they had the substance in their possession.
