Convictions for sexual offences against children under ss 210(1)(a) and 210(1)(e) of the Criminal Code (Qld) ought ordinarily to be recorded. The community interest in enabling those with care of children to discover past sexual offences is a weighty factor under s 12(2) of the Penalties and Sentences Act 1992 (Qld). A sentencing judge who accepts submissions about career consequences of recording convictions must be satisfied those consequences are properly established on the evidence. Section 5(2) of the Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld) does not authorise positive denial of an unrecorded conviction.
