In personal injury actions in Tasmania, a defendant cannot use s 25 of the Evidence Act 1910 (Tas) to compel a plaintiff to provide an authority for access to medical records to the defendant; the obligation to provide facilities and information runs only to the examining medical practitioner. While s 26(1) encompasses documents as 'personal property', it only permits orders for inspection of particular identified documents directed to the person in possession, not orders for general authorities enabling wide-ranging enquiries.
