A sentence of three years' imprisonment for a single episode of aggravated burglary and stealing (safe-breaking) was manifestly excessive where the offender pleaded guilty and played a lesser facilitating role, notwithstanding extensive criminal antecedents and parole violation. Two years six months was substituted. The statistically established range for single episodes of burglary and stealing in Tasmania (up to approximately two years) is a guideline only and may be exceeded for safe-breaking and professional offending, but any increase in sentencing levels should be incremental.
