Expert evidence about the unreliability of 'recovered memory' is inadmissible where the complainant's evidence, fairly read, is that she always remembered the abuse but pushed it to the back of her mind — this is not 'repressed memory' in the technical sense. Trial directions on delayed complaint in sexual offence cases must reflect that victims of sexual abuse are not to be treated like merchants whose silence may condemn them. An expert witness must identify the facts assumed as the basis of opinion and may not rely on material not before the jury.
