Section 13(1) of the Sentencing Act 1991 is concerned only with irregularity — a failure to comply with the requirements of s.11 — and does not confer jurisdiction on the Court of Appeal where the sentencing court has deliberately exercised the discretion under s.11(1) to decline to fix a non-parole period. The appropriate remedy in such cases is an application for leave to appeal against sentence. R v Lange should not be followed on this point.
