A superannuation trustee is not obliged to consider medical evidence that comes to its attention only through discovery in litigation, absent a specific request by the member to reconsider the TPD claim. The member's entitlement is not foreclosed by an initial rejection based on inadequate medical evidence — the member may submit further evidence at any time and the trustee is bound to consider it if requested. The Deed definition of TPD ('unlikely ever to resume work in or attend to any gainful profession or occupation') is wider than a typical insurance policy definition limited to occupations for which the member is qualified by education, training or experience.
