SCR Pt 51AA r 18 confers a power to order restitution, not a discretion to refuse it; where a judgment has been reversed, the court must order restitution regardless of whether a new trial is pending. Costs paid to solicitors on account are paid as agents for the party, and only the party is liable to repay on reversal. Appellants who fail to seek restitution at the hearing of the appeal will bear the costs of subsequent proceedings to obtain it.
