A costs assessor whose decision is challenged in judicial review proceedings is, as a matter of policy, immune from costs orders absent misconduct or bad faith, by analogy with the immunity accorded to referees under the Supreme Court Rules as established in Najjar v Haines. Where a party actively participates in opposing the judicial review application, that party rather than the decision-maker is the proper costs respondent.
