A manufacturer's misleading product label can ground liability under s 82 of the Trade Practices Act even where the injured person never read the label, provided the misleading label contributed to the injury through an intermediary such as a supervisor. Section 151Z of the Workers Compensation Act 1987 applies to reduce damages in Trade Practices Act claims where the employer also contributed to the injury. A common liability for contribution purposes is not destroyed by the way the cause of action is framed.
