Impecuniosity of an appellant combined with slim prospects of success does not constitute 'special circumstances' for security for costs under Pt 51 r 16 where the appeal is genuine and an order for security would effectively frustrate the appeal. The court will not frustrate an appellant's prima facie right to pursue a genuine appeal merely because the appellant is impecunious.
