The Jurisic sentencing guidelines for s 52A offences apply with full force: where aggravating factors demonstrating abandonment of responsibility are present, a custodial sentence of less than two years for grievous bodily harm should be exceptional. Contributory negligence or voluntary assumption of risk by the victim cannot operate as a mitigating factor in criminal sentencing under s 52A. Home detention is not to be regarded as equivalent to imprisonment for the purposes of the Jurisic guidelines. Family hardship will only be taken into account in the most exceptional circumstances, and the fact that arrangements have been made for the care of older children will generally not qualify.
