Section 165(1) of the Evidence Act 1995 (NSW) is not limited to the enumerated categories of potentially unreliable evidence; evidence of corrupt police officers who are prepared to lie falls within the general provision. Where one police officer gives evidence of corruption by other officers involved in the investigation, the trial judge must warn the jury that the evidence of those other officers may be unreliable, even where the allegations are denied. The concept of 'suffering or permitting' in s 6 of the Drug Misuse and Trafficking Act 1985 (NSW) requires more than mere knowledge of the presence of drugs; in the context of a de facto relationship where the lease is nominally in one partner's name, the court must consider whether the lessee had any real power to prevent the other partner's conduct.
