The Jurisic sentencing guidelines for dangerous driving under s 52A(1) and (3) must be proportionately increased for the aggravated offence under s 52A(2) where the maximum penalty is fourteen years. A sentence of periodic detention for aggravated dangerous driving causing death with a blood alcohol reading of 0.243 is manifestly inadequate where general deterrence is not given appropriate weight. On Crown appeal resentencing, the double jeopardy principle requires imposition of the least sentence that could properly have been imposed at first instance.
