Leave to file a cross-claim will not be granted after reasons for judgment have been published where the proposed cross-defendants would not be bound by the existing findings, there is a risk of inconsistent findings, and the objectives of the cross-claim procedure cannot be achieved. The prospect of Anshun estoppel does not justify the grant of leave where the estoppel would not in any event apply to claims against non-parties. Where a successful party fails on a clearly dominant or separable issue, the court may reduce the costs award proportionately, but will not attempt mathematical precision.
