Section 13A of the Penalties and Sentences Act 1992 (Qld) is permissive, not mandatory: it prescribes procedures to be followed if a sentence is to be reduced for cooperation, but does not require any reduction. A sentencing judge retains the responsibility to impose a just sentence and is not bound by a Crown prosecutor's recommendation arising from a plea bargain. Co-offenders jointly charged should be sentenced together to enable proper assessment of relative culpability.
