Under s 118(2)(b) of the District Court Act 1967 (Qld), in money claims an appeal lies as of right from the District Court only if the amount claimed in the plaint is $50,000 or more and there is a live contention that there should be a judgment for $50,000 or more. This applies to both plaintiffs' and defendants' appeals. Rule 363A of the District Court Rules does not limit the broad costs discretion under Rule 363 where the judgment exceeds $20,000, and a District Court judge retains a discretion comparable to that of a Supreme Court judge to award costs otherwise than according to the Schedule.
