The Queensland Court of Appeal allowed the Attorney-General's appeal against sentence, holding that a sentence of two years imprisonment with parole eligibility after six months for dangerous operation of a vehicle causing grievous bodily harm (with a blood alcohol concentration of 0.174) was manifestly inadequate. The Court substituted a sentence of three years imprisonment with parole eligibility after 12 months and a three-year driver's licence disqualification, following a review of comparable sentencing authorities.
