A parole recommendation made in respect of an earlier sentence ceases to exist upon automatic cancellation of parole under s 187(1) of the Corrective Services Act 1988, and s 157(3) of the Penalties and Sentences Act 1992 has no application where there is no current or existing parole recommendation. Courts should not circumvent the statutory effects of parole cancellation and cumulative sentencing requirements by making specially early parole recommendations.
