The requirement that a serious violent offender serve 80 per cent of the sentence before parole eligibility under Part 9A of the Penalties and Sentences Act 1992 (Qld) is not a proper reason to impose a lesser head sentence than would otherwise be appropriate. Deterrent sentences are warranted where offenders respond to aggressive conduct by obtaining firearms and returning to a confrontation rather than retreating and calling police.
