Section 30(1) of the Criminal Law (Sentencing) Act 1988 (SA) confers a general power to specify a commencement date for a sentence of imprisonment that is later than the date of imposition, including at the expiration of a sentence of detention in a training centre. Section 31(1) does not authorise making a sentence of imprisonment cumulative upon a sentence of detention. However, the exercise of the power under s 30(1) to fix a later commencement date should only occur in exceptional circumstances outside the situations contemplated by s 30(3) and (6). There is no power to fix a single non-parole period spanning both a period of detention and a sentence of imprisonment.
