A solicitor who has acted for a client in a particular transaction will be restrained from acting against that former client in an appeal concerning the very same transaction, even where no question of confidential information arises, where the present client takes a passive attitude to the appeal, and where the objection is raised late. The Court of Appeal has jurisdiction to restrain solicitors from acting in appeals before it.
