Digital rape should generally result in an immediate custodial sentence of substantial duration, and the sentencer should ensure a substantial part of the sentence is actually served. A plea of guilty, previous good character, and genuine remorse do not displace this general expectation. A sentence of four years' imprisonment with an 18-month non-parole period was within the permissible range for a brief digital rape by an offender of excellent character. The offence of rape cannot be wholly separated from its effect on the victim when assessing gravity.
