The automatic disqualification rule for pecuniary interest does not operate to disqualify a judge by reason of mere shareholding in a party; the judge's pecuniary interest must be one that will or might be affected by the outcome of the proceedings. Where a judge acquires an interest after trial but before judgment, and a critical witness has since died, the doctrine of necessity may require the judge to deliver judgment notwithstanding the interest. A bank's duty of care to a foreign currency borrower is limited to warning of the general risks of exchange rate fluctuations and does not extend to refusing to make the loan or exhorting the borrower not to proceed.
