A member of the Australian Federal Police is not an 'investigating official' within the meaning of s.464 of the Crimes Act 1958 (Vic.), but may have equivalent powers and duties by virtue of s.9(1)(c)(iv) of the Australian Federal Police Act 1979 (Cth) when acting in relation to the safeguarding of Commonwealth interests. The question whether earlier untaped questioning is part of 'the questioning' required to be tape-recorded under s.464H(1)(d) is always one of fact and degree; reference back to earlier questions for the purpose of introducing a topic does not necessarily make the earlier and later questioning 'all of a piece'. The offences of conspiracy to make and conspiracy to use false documents under s.83A(1) and (2) are distinct offences and concurrent sentences do not constitute double punishment.
