The Registrar of the Court of Appeal has no power under s.582A of the Crimes Act 1958 to grant leave to the Director of Public Prosecutions under s.567A(3) to serve a notice of Crown appeal against sentence out of time; such leave must be obtained from the Court of Appeal itself. Leave under s.567A(3) operates only prospectively and cannot validate service already effected without proper leave. The Director's right of appeal is not extinguished by failure to serve within time, but a fresh application to the Court of Appeal is required.
