A sentencing judge's error as to the maximum penalty for an offence does not necessarily vitiate the sentencing discretion; the question is whether the error was material in the circumstances, having regard to the magnitude of the discrepancy and the sentence actually imposed relative to the true maximum. Where the error is relatively modest and the sentence imposed is well within the true maximum, the error may be characterised as immaterial.
