An order refusing to revoke a deemed custodial supervision order under Schedule 3 of the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 constitutes an order 'confirming' a supervision order for the purposes of the right of appeal under s.34. In exercising the discretion to revoke under clause 4(2), the court is entitled to consider the overall objectives of the Act including graduated reintegration, and is not bound to accept unanimous expert psychiatric opinion. The progressive lessening of controls is not a mandatory precondition to revocation for existing detainees, but the court may take it into account.
