An incorporated sporting association stands in a contractual relationship with its individual members, even where the member's connection is through an affiliated club and capitation fees. There is a serious question to be tried as to whether a term of fairness in selection processes is to be implied ad hoc into that contract, applying the Codelfa officious bystander test. However, such implied fairness is not equivalent to natural justice — it extends only to prohibiting the consideration of irrelevant matters. An executive committee's power to manage an association does not extend to intervening in player selection where the constitution vests that function in a distinct selection committee.
