Where a charge of being knowingly concerned in co-offenders' importations is withdrawn, the sentencing court may take into account the offender's organisational role (recruiting, coordinating, collecting drugs) as showing the offender was more than a 'mere courier' for the purpose of the offence to which they pleaded guilty, but must not cross the line into sentencing for the withdrawn charge. A 33% disparity between the applicant's sentence and co-offenders' sentences was held to give rise to a justifiable sense of grievance where the offences were nearly identical in quantity and circumstances of importation.
