A person can only be punished for offences with which they are charged; admitted but uncharged offences are relevant only as background and to prevent the offender claiming the charged offence was an isolated incident. A total effective sentence of four years' imprisonment for cannabis cultivation (69 plants), possession with intent to sell (735g), and sale offences over a 12-month period generating $13,000 profit was within the permissible range under s 34(2) of the Misuse of Drugs Act 1981 (WA).
