The expression 'other serious circumstances' in the definition of 'special need relative' in reg 1.03 of the Migration Regulations 1994 (Cth) can comprehend the circumstances of a young child who, by virtue of age and inability to care for itself, has a long-term need for substantial and continuing assistance from a relative. The earlier Full Court decision in Huang, which held to the contrary, was not binding as the relevant observations were obiter dicta. The definition requires the need for assistance to be an existing one at the time of decision; a future need is not sufficient.
