The word 'responsibility' as used in the Local Government Act 1993 (NSW), s 7(d), and the Constitution Act 1902 (NSW), s 51(1), does not impose a legally enforceable obligation on councils to exercise enforcement powers at the instance of third parties. Council enforcement powers under ss 124 and 673 of the Local Government Act 1993 are discretionary, and a council commits no legal error by deferring enforcement action provided it has turned its mind to the exercise of its powers. The Land and Environment Court's jurisdiction under s 676(1) is confined to legal error and does not extend to merits review of council enforcement decisions.
