A party seeking to set aside a single judge's refusal of a stay pending appeal must satisfy the House v The King principles. Where the respondent has assets sufficient to permit recovery of the judgment sum if the appeal succeeds, the appeal is not rendered nugatory and a stay may properly be refused. Matters not raised before the single judge cannot ground a complaint that the judge erred in not dealing with them.
